These Terms of Use (“Terms”) are a legal agreement between you and Sunset Works s.r.o., a company registered in the Czech Republic (“Sealby”, “we”, “us”), governing your use of the Sealby app and this website. By downloading or using Sealby, you agree to these Terms. If you do not agree, do not use Sealby. You must be at least 13 years old (or the minimum age of digital consent in your country) to use Sealby.

1. Your license

We grant you a personal, limited, non-exclusive, non-transferable license to use Sealby on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and Usage Rules. You may not copy, modify, distribute, sell, rent, reverse engineer, or attempt to extract the source code of Sealby, except to the extent the law permits it despite this restriction.

2. Encryption, recovery, and irreversible features

Sealby is built so that no one but you can access your data. There is no account, no server-side copy of your keys, no master key, and no backdoor. This design has consequences you must understand and accept:

  • Lost credentials mean lost data. If you lose access to a vault (its PIN, pattern or passphrase) and its recovery phrase, that vault cannot be recovered — not by us, not by Apple, not by anyone. You are solely responsible for recording and safeguarding each vault’s recovery phrase, separately from your device.
  • The duress PIN is destructive by design. If you choose to configure a duress PIN, entering it permanently and irreversibly destroys the data it is configured to destroy. There is no undo, grace period, or recovery.
  • “Destroy all data” is permanent. Deletion features are immediate and irreversible by design.
  • Backups are your responsibility. The optional Premium iCloud backup stores only an encrypted blob that can be restored solely with the corresponding recovery phrase. Without backup enabled, your data exists only on your device.

You accept sole responsibility for your data. Keeping independent copies of anything you cannot afford to lose, safeguarding your PINs, passphrases and recovery phrases, and deciding whether to enable destructive features are your decisions and yours alone. To the maximum extent permitted by law, we accept no responsibility or liability for any loss, deletion, corruption, or unrecoverability of data, however caused — including loss resulting from lost credentials, use of the duress PIN or deletion features, a lost, damaged, reset or wiped device, disabled backups, software error, or any other cause. You accept this allocation of responsibility as an essential condition of using Sealby.

3. Your responsibilities and acceptable use

You are solely responsible for the content you store in Sealby and for complying with the laws that apply to you. You agree not to use Sealby to store or manage content whose possession or distribution is unlawful, or to use the app in any way that violates applicable law. Sealby’s privacy features protect lawful private life; they do not change what the law permits.

4. Free tier, Premium, and billing

Sealby’s free tier is available at no charge and includes the full core feature set, limited to 100 files per vault. Premium removes that limit and unlocks additional features (such as encrypted iCloud backup, multi-device sync, and vault sharing). Premium is offered as an auto-renewing subscription (monthly or yearly) or a one-time lifetime purchase, purchased through Apple’s In-App Purchase system:

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Subscriptions automatically renew at the end of each period (monthly or yearly, as selected) unless cancelled at least 24 hours before the end of the current period; the renewal charge is applied to your Apple Account within 24 hours before the current period ends.
  • You can manage or cancel subscriptions at any time in your App Store account settings (Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
  • Subscriptions may include a free introductory trial (currently 7 days). A trial converts into a paid subscription automatically unless you cancel at least 24 hours before the trial ends. One introductory trial is available per Apple Account across Sealby’s subscription plans; any unused portion of a trial is forfeited when you purchase a subscription or the lifetime unlock.
  • Prices are shown in the App Store before purchase and may vary by region. If prices change, Apple will notify you as required and, where applicable, request your consent before charging the new price.
  • Purchases and refunds are processed by Apple under Apple’s terms; to request a refund, use Apple’s refund process at reportaproblem.apple.com.
  • The lifetime purchase is a one-time, non-consumable purchase for the lifetime of the product, restorable on your devices via “Restore Purchases”.

5. Privacy

Sealby requires no account and collects no content. What little there is to say is in our Privacy Policy, which forms part of these Terms.

6. Intellectual property

Sealby, including its software, design, branding and content (but excluding your stored content, which remains yours), is owned by us and protected by intellectual-property laws. These Terms grant you no rights other than the license above.

7. Terms that apply because Sealby is distributed on the App Store

These Terms are between you and us only — not with Apple Inc. (“Apple”). Apple is not responsible for Sealby or its content. The following terms apply to your use of Sealby as required by Apple:

  • Maintenance and support. We — not Apple — are solely responsible for Sealby and for providing any maintenance and support for it. Apple has no obligation to furnish any maintenance or support services for Sealby.
  • Warranty. In the event of any failure of Sealby to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Sealby; any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
  • Product claims. We — not Apple — are responsible for addressing any claims by you or a third party relating to Sealby or your possession and use of it, including (i) product liability claims, (ii) claims that Sealby fails to conform to applicable legal or regulatory requirements, and (iii) claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual-property claims. In the event of a third-party claim that Sealby or your possession and use of it infringes that third party’s intellectual-property rights, we — not Apple — are solely responsible for the investigation, defence, settlement and discharge of such claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using Sealby (for example, your wireless data service agreement).
  • Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

8. Disclaimer of warranties — including security and data

To the maximum extent permitted by law, Sealby is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

In particular, and to the maximum extent permitted by law, we make no representation, warranty, or guarantee of any kind that Sealby or any data stored in it will be secure, confidential, uninterrupted, error-free, or free from unauthorised access, loss, deletion, corruption, or destruction. Descriptions of Sealby’s design and encryption on this website or in the app are descriptions of how the software is built, not a warranty, guarantee, or assumption of responsibility for any security or data-integrity outcome. No security technology is absolute, and you use Sealby at your own risk. Nothing in these Terms limits warranties or rights that applicable consumer law grants you and that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss, deletion, corruption, disclosure, or destruction of data of any kind (including vault contents, recovery phrases, and backups) — however caused, whether by lost credentials, destructive features operating as designed, software error, unauthorised access, device failure, or otherwise — or for loss of profits or goodwill, arising from or related to your use of, or inability to use, Sealby. To the maximum extent permitted by law, our total aggregate liability for all claims relating to Sealby is limited to the greater of the amount you paid us for Sealby in the twelve months before the claim arose, or fifty (50) U.S. dollars. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

10. Termination

These Terms are effective until terminated. They terminate automatically if you fail to comply with them; upon termination you must stop using Sealby and delete it. You may stop using Sealby at any time. Sections that by their nature should survive termination (including sections 2, 6, 8 and 9) survive.

11. Changes to these Terms

We may update these Terms from time to time — for example, when features change. The “Last updated” date above reflects the current version, and material changes will be communicated in the app or on this site. Continuing to use Sealby after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles. The courts of the Czech Republic have jurisdiction over disputes arising from these Terms. If you are a consumer, you additionally keep any mandatory consumer protections — and any right to bring proceedings in your own country — that the law of your country of residence grants you and that cannot be excluded by agreement.
